Alternative Dispute Resolution In Surrogacy Matters

Time is limited during a pregnancy. If a dispute arises, you want a quick and effective resolution. Alternative dispute resolution (ADR) can provide you with the opportunity to reach an agreement amicably and preserve the parent/surrogate relationship.

We at Essig & Evans LLP have been assisting clients with surrogacy and family building needs since 1986. Whether you are an intended parent or surrogate, our lawyers can help you understand your options, protect your rights and reach a mutually beneficial agreement with the other party to your surrogacy.

Types Of Alternative Dispute Resolution

There are a variety of alternative dispute resolution methods available to those who want to resolve their disputes outside of litigation. Our firm can help you resolve your differences, large or small, in many ways, including:

  • Mediation: In mediation, a neutral third party, known as a mediator, helps you and the other party reach an agreement through open communication and discussion. Mediation is often suggested in surrogacy contracts and can be helpful in reaching an agreement should issues arise.
  • Arbitration: Similar to a judge, an arbitrator listens to the arguments and evidence from both parties and then comes to a decision. Unlike a trial, arbitration is usually faster, costs less money and is less formal.
  • Counseling and cooperation: Sometimes, a simple counseling session is enough to help both parties come together and reach an agreement. Cooperation can keep the costs of the dispute down while still giving you a chance to voice your concerns and protect your rights during the surrogacy.
