It does not take much to find a piece of paper that will outline the basics of any surrogacy contract, but in most cases, the law is much more complicated, especially if litigation is involved. You should understand two things before you draft or sign any surrogacy contract:

  • Choice of Law: Which state law is going to apply to your surrogacy arrangement? This is an important consideration when intended parents and surrogates reside in different states. You need to choose a state that will allow for your desired result, whatever that may be.
  • Choice of Attorney: You need an attorney who is familiar with the law of your state and can help identify competent legal counsel to help review the contract and, if needed, secure the Birth Order in an efficient, cost-effective way. For example, if you are an Intended Parent in Illinois and choose to work with a surrogate in Virginia, I can find the attorney in Virginia and will make sure you have someone on board who can help you accomplish your goals.
